Selling Home Baked Goods

Baking enthusiasts in Allegheny County could not sell a single homemade cookie, cupcake or loaf of bread until May 2021, when the Institute for Justice intervened on behalf of an aspiring cottage food producer in Pittsburgh. Prior to that time, Allegheny County banned all cottage food sales in all venues. Code enforcers even sent cease-and-desist letters during the COVID-19 pandemic, cutting off a source of home-based income while simultaneously advising people to work from home as much as possible. Volunteers could organize bake sales for charity, but they could not sell the same foods made in the same kitchens for profit. If people wanted to keep revenue for themselves, they had to spend tens of thousands of dollars to rent or build a commercial-grade kitchen. Allegheny County lifted its cottage food ban after meeting with the Institute for Justice. Producers still must comply with state law.

Selling Homemade Food In Maryland

People love fresh-baked cookies and cakes right out of the oven. Yet selling homemade food was illegal at most venues in Maryland until 2018. Prior to legislative reforms passed that year, Maryland had some of the strictest limits in the nation, allowing homemade food producers to sell their goods only at farmers markets and special events. Now, with a law supported by the Institute for Justice, homemade food producers may sell their goods directly from home or through mail deliveries.

Since then, Maryland has enacted multiple reforms, allowing homemade food sales at retail stores and food co-ops in 2019, letting homemade food producers to replace their home address with an ID number on product labels in 2020, before raising the sales cap to $50,000 in 2022. Read more about

How To Start A Home

If you’re ready to start baking up profits, here are the steps to launching your home based baking business.

  • Find out the laws and regulations of your state regarding food service businesses.
  • Obtain needed licenses and permits to start your business. Your city or county government officials will have this information. You might be able to get the details you need and file for your license online.
  • Contact your state’s tax or comptroller’s office about whether or not you need to collect sales tax on your food items. Often times, you can get your sales tax permit online. They’re usually free, but require you to pay the sales tax monthly or sometimes quarterly, on the items you sell.
  • Find out if you need to collect a food tax. Some states and localities not only collect sales tax, but have additional tax on food items. Most states and locations have business startup information on their official websites that should help you answer this question and get information on how to do it.
  • Create an LLC or other business entity to best protect your personal assets from a lawsuit if someone should get sick or have problems with your food items. If you have a partner in your venture, you’ll want to set up a partnership.
  • Write a business plan.
  • Purchase separate cooking equipment and supplies. This is probably a requirement in your state, but also helpful in keeping your personal and business separate, including the expenses for home business tax purposes.
  • Bake your goodies.
  • Ship Baked Goods At The Beginning Of The Week
