Anthony Thompson Jr Video

After a Knoxville police officer shot and killed Anthony Thompson Jr. in an Austin-East Magnet High School bathroom in April 2021, Allens office refused to release the video to the public.

Knoxville media organizations, led by Knox News, joined an effort by Mayor Indya Kincannon to ask a judge to decide whether Kincannon had authority to release the video footage on her own. Kincannon, Knoxville Police Chief Eve Thomas, the Knoxville NAACP and all four of the officers involved in the shooting also pushed for release of the video.

At the time, Allen said the clamor for the video made it more difficult to conduct the work of determining whether police were justified in the fatal shooting. She eventually released the video in a long public presentation, and her office cleared the officers involved, saying they acted in self-defense and the defense of others.

Sanctions Sought Against Lawyer In Inmate Beating Suit

Lawyers for several Knox County jailers being sued over the November 2014 beating of an inmate want his lawyer tossed off the case and gagged from speaking to the press.

The federal court action is being sought against Lance Baker, who represents Louis W. Flack, a former Knox County inmate who authorities say was beaten while jail personnel were trying to move him from a cell.

Flack, through Baker, is suing Knox County and the jail workers in U.S. District Court over the incident.

Baker declined comment Monday.

Lawyers for David C. Sparkes, Jesse Rudd, Christopher Fustos and Randall Kidd seek sanctions against Baker, accusing him of improperly speaking about the case to area media outlets including WBIR, 10News.

They contend lawyers associated with pending civil cases aren’t supposed to make “extrajudicial” or out-of-court statements if such statements involve the evidence or character of people involved in the case.

The defense attorneys also say Baker isn’t allowed to make comments that could interfere with the defense getting a fair trial and an unbiased jury.

According to the lawyers, Baker made available video of the moment Flack was removed from and beaten in his county cell. They say they hadn’t even seen the video, which offers a closer look at what happened than footage released last year by Knox County Sheriff Jimmy “J.J.” Jones.

Baker’s comments were designed to put the defendants “in a negative light,” the lawyers argue in the court filing.

Not Releasing The Video

City attorneys met with the family Thursday to review the video footage of Bailey’s arrest and time in custody ahead of a planned release of the video to the public. The family was able to watch the footage except, their attorney Lance Baker said, a 12-minute clip that was inadvertently left out of the viewing.

What the family was shown does not depict any struggle between Bailey and officers, Baker said, but that doesnt mean his arrest was handled properly.

It doesnt always have to be excessive force. What about lack of medical care … we just have more questions than answers, he told Knox News Friday.

A few hours after the family left, Baker said, a city attorney called to explain they inadvertently failed to show the family the 12-minute video of the end of the transport, after Bailey required assistance. However, the city was now prohibited from showing the video to the family because in the meantime, Allen, the DA, sought and received a court order signed by Judge Steven W. Sword sealing the case.

Early Friday morning, Baker released a statement critical of the decision to withhold the video and of Allen’s failure to contact the family about her successful effort to prevent its release.

Was he assaulted? Did he have a heart attack or other medical emergency? Why is this information being kept a secret? Why cant his own family know what happened? Baker said in the statement.

Judge Chides Attorney Over Comments As Excessive Force Suit Looms Against Blount Law Enforcement

KNOXVILLE A federal judge chided an attorney for stepping over the line when he spoke to the press this summer about his clients excessive force lawsuit against Alcoa and Blount County law enforcement, but said he would not impose any formal gag orders in the case.

Knoxville attorney Gary Prince was asking U.S. Magistrate Judge C. Clifford Shirley Jr. to issue a gag order against fellow Knoxville attorney Lance Baker over comments Baker made to The Daily Times earlier this year.

Baker, who contacted The Daily Times in May after the paper published an update on the pending lawsuit, told Shirley he was merely trying to combat what he felt was undue prejudice against his client in her $2 million lawsuit against the city of Alcoa, the Blount County government and several law enforcement officers from both jurisdictions including Blount County Sheriff James Lee Berrong and former Alcoa Police Chief Philip Potter.

Several claims against Berrong have since been dismissed.

The Daily Times published a subsequent story following a May 12 meeting with Baker. In it, Baker argued the lawsuit could have been avoided if law enforcement had recognized his clients obvious mental distress and provided appropriate care.
